Residence swap

An Argentinian couple has lived in the Netherlands for over 3 years. One was recruited as a highly skilled migrant and is considering continuing as a self-employed entrepreneur. It is very challenging to acquire a self-employed entrepreneur's visa even if the applicant has been living for many years in the Netherlands. The point system does not distinguish between newcomers and people who are already residents. That's why we proposed our clients to a swap. This means that the partners will change positions. The entrepreneur will apply for a partner visa while the other partner will apply for a permit of residence as a highly skilled migrant. This allows the entrepreneur to build up a company without any drawbacks connected to the residence permit. Although the conditions are clear, it remains vital that the applications are filed in the correct sequence and that the employer of the partner has already been recognized as an official sponsor.
